Social Security for Children of Gay Couples
According to this article, the Department of Justice has determined that the Federal Defense of Marriage Act (DOMA) does not prevent the children of those couples where an existing parent/child relationship exists.
It sounds like if one member of the couple has a child when in a marriage or civil union then that creates a parent/child relationship between the non-biological parent and the child. It is that relationship and not DOMA that appears to be the determining factor. It appears that the same reasoning would hold for second parent adoptions.
This is good news, at least for the children. And, it appears a court case wasn't even needed (though I could be wrong). Regardless, if you have children then you should check out how this might benefit your family.
